{"id":107157,"date":"2022-06-02T15:45:56","date_gmt":"2022-06-02T21:45:56","guid":{"rendered":"https:\/\/nbcs.mx\/?p=107157"},"modified":"2022-06-02T15:45:56","modified_gmt":"2022-06-02T21:45:56","slug":"en-bcs-los-embargos-precautorios-y-relacionados-con-creditos-laborales-no-operara-la-caducidad","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=107157","title":{"rendered":"En BCS los embargos precautorios y relacionados con cr\u00e9ditos laborales, no operar\u00e1 la caducidad"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-107158 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-755x331.jpeg\" alt=\"\" width=\"397\" height=\"174\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-755x331.jpeg 755w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-1024x449.jpeg 1024w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-150x66.jpeg 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-768x337.jpeg 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602-1536x674.jpeg 1536w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/PLENO-PANORAMICA-220602.jpeg 1600w\" sizes=\"auto, (max-width: 397px) 100vw, 397px\" \/>La Paz, Baja California Sur.- Con el objeto de proteger el derecho de los trabajadores y trabajadoras, a hacer efectivos los laudos y sentencias a trav\u00e9s del sostenimiento del registro de las medidas precautorias y embargos dictados por la autoridad laboral ante la autoridad registral local, el Congreso de Baja California Sur aprob\u00f3 por unanimidad que en embargos precautorios y relacionados con cr\u00e9ditos laborales, no operare la caducidad.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">La iniciativa con proyecto de decreto mediante la cual se adicionan un p\u00e1rrafo tercero y un p\u00e1rrafo cuarto al art\u00edculo 2945 del C\u00f3digo Civil para el estado de Baja California Sur, propuesta el 25 de noviembre del a\u00f1o 2021 por la diputada Mar\u00eda Luisa Trejo Pi\u00f1uelas, fue analizada por la Comisi\u00f3n Permanente de Puntos Constitucionales y de Justicia, quienes dictaminaron favorable la iniciativa al considerar que dicha reforma dar\u00e1 certeza jur\u00eddica a las trabajadoras y trabajadores, que independientemente del tiempo en el que transcurra la presentaci\u00f3n de la demanda laboral hasta la conclusi\u00f3n del juicio, la inscripci\u00f3n del embargo precautorio, permanecer\u00e1 firme sin que sea necesario hacer promociones para que se tenga por ratificado el embargo cada determinado tiempo.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">No obstante, la comisi\u00f3n dictaminadora, consider\u00f3 necesario realizar algunas modificaciones de forma para dar mayor claridad a la reforma, sustituy\u00e9ndose en el cuarto p\u00e1rrafo la palabra <em>\u201cdecretar\u00e1\u201d<\/em> por <em>\u201corden\u00f3\u201d,<\/em> en el quinto p\u00e1rrafo <em>\u201corden\u201d<\/em> por <em>\u201cmandamiento\u201d<\/em> y en ese mismo p\u00e1rrafo, se excluya la frase <em>\u201ccompetente en materia laboral\u201d,<\/em> ya que la adici\u00f3n se refiere a embargos precautorios y embargos relacionados con cr\u00e9ditos laborales que solo pueden ser levantados por orden de la autoridad que los ordeno, tal y como lo prev\u00e9 la norma jur\u00eddica adicionada.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>La Paz, Baja California Sur.- Con el objeto de proteger el derecho de los trabajadores y trabajadoras, a hacer efectivos<\/p>\n","protected":false},"author":1,"featured_media":107158,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-107157","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
