{"id":107602,"date":"2022-06-09T17:16:27","date_gmt":"2022-06-09T23:16:27","guid":{"rendered":"https:\/\/nbcs.mx\/?p=107602"},"modified":"2022-06-09T17:16:27","modified_gmt":"2022-06-09T23:16:27","slug":"propone-gabriela-montoya-castigar-abuso-de-autoridad","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=107602","title":{"rendered":"Propone Gabriela Montoya castigar abuso de autoridad"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-107603 alignright\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/DIP-GABRIELA-MONTOYA-TERRAZAAS-220609-1-730x492.jpg\" alt=\"\" width=\"381\" height=\"257\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/DIP-GABRIELA-MONTOYA-TERRAZAAS-220609-1-730x492.jpg 730w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/DIP-GABRIELA-MONTOYA-TERRAZAAS-220609-1-150x101.jpg 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/DIP-GABRIELA-MONTOYA-TERRAZAAS-220609-1-768x518.jpg 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2022\/06\/DIP-GABRIELA-MONTOYA-TERRAZAAS-220609-1.jpg 1024w\" sizes=\"auto, (max-width: 381px) 100vw, 381px\" \/>La Paz, Baja California Sur.- La Presidenta de la Mesa Directiva del Congreso del Estado e integrante de la Fracci\u00f3n Parlamentaria del PT, diputada Gabriela Montoya Terrazas present\u00f3 al Pleno iniciativa con proyecto de decreto que busca modificar el C\u00f3digo Penal para el Estado de Baja California Sur al proponer adicionar una fracci\u00f3n XI al art\u00edculo 274.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">El art\u00edculo 274 que habla sobre abuso de autoridad y uso ilegal de la fuerza p\u00fablica, se\u00f1ala que: cometen el delito de abuso de autoridad y uso ilegal de la fuerza p\u00fablica los servidores p\u00fablicos que en perjuicio de particulares, en raz\u00f3n de sus funciones y con los medios o la autoridad que estas le otorguen, incurra en los abusos que se\u00f1alan las fracciones ya establecidas.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Con la adici\u00f3n de la facci\u00f3n XI que se pretende adicionar se agrega como abuso de autoridad cuando un servidor p\u00fablico \u201cRetenga, en todo o en parte, los salarios de los trabajadores, por concepto de multa, o cualquier otro concepto que no est\u00e9 autorizado legalmente, o en su caso, el trabajador no consienta dicho descuento.\u201d<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Se\u00f1al\u00f3 la legisladora en su intervenci\u00f3n que la Iniciativa con Proyecto de Decreto tiene como fin fortalecer y garantizar los derechos de las y los trabajadores ante abusos e injusticas laborales, castigando con ello a aquel patr\u00f3n que de manera arbitraria y contraria a derecho prive al trabajador del producto de su trabajo.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Al final, agreg\u00f3 la diputada del PT que no se debe permitir que ning\u00fan otro patr\u00f3n est\u00e9 por encima de los derechos laborales.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">La iniciativa fue turnada para su revisi\u00f3n y discusi\u00f3n a la Comisi\u00f3n Permanente de Puntos Constitucionales y de Justicia para su an\u00e1lisis y dictaminaci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Paz, Baja California Sur.- La Presidenta de la Mesa Directiva del Congreso del Estado e integrante de la Fracci\u00f3n<\/p>\n","protected":false},"author":1,"featured_media":107603,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-107602","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
