{"id":121784,"date":"2023-02-21T19:28:31","date_gmt":"2023-02-22T02:28:31","guid":{"rendered":"https:\/\/nbcs.mx\/?p=121784"},"modified":"2023-02-21T19:28:31","modified_gmt":"2023-02-22T02:28:31","slug":"proponen-facultar-a-uno-y-no-necesariamente-tres-diputados-para-reformar-la-constitucion-del-estado","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=121784","title":{"rendered":"Proponen facultar a uno y no necesariamente tres diputados para reformar la Constituci\u00f3n del Estado"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-121785 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2023\/02\/DIP-MARIA-GUADALUPE-MORENO-HIGUERA-230221-5-743x492.jpg\" alt=\"\" width=\"326\" height=\"216\" \/>La diputada Mar\u00eda Guadalupe Moreno Higuera (Morena) present\u00f3 al pleno una iniciativa que tiene por objeto modificar la Ley Org\u00e1nica del Poder Legislativo del Estado de Baja California Sur, con el objeto de eliminar la condici\u00f3n de que, para efectos de reformar o adicionar la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Baja California Sur, \u00e9sta ya no deba necesariamente estar suscrita por una trilog\u00eda de legisladores, y que por el contrario se faculte a alg\u00fan diputado para tales efectos.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Moreno Higuera, argument\u00f3 que, estipular como requerimiento una trilog\u00eda de legisladores,restringe la libertad individual para plasmar una visi\u00f3n, idea, necesidad, perspectiva o determinaci\u00f3n progresiva de reformar o adicionar el texto constitucional local cuartando el derecho al ejercicio como diputado local, toda vez que la norma vigente no permite reformar la constituci\u00f3n local cuando el instrumento que ponga en marcha el proceso legislativo est\u00e9 firmado por uno, dos, cuatro, cinco, seis y m\u00e1s diputados, puesto que, en sentido estricto, la \u00fanica f\u00f3rmula para el proceso legislativo, trat\u00e1ndose de reformar o adicionar la Constituci\u00f3n por parte del Congreso, es aquella compuesta por tres diputados.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">La legisladora, refiri\u00f3 que, al existir un conflicto o contradicci\u00f3n entre el art\u00edculo 57, fracci\u00f3n V, de la Constituci\u00f3n Pol\u00edtica, los art\u00edculos 100, fracci\u00f3n V y 223 de la Ley Org\u00e1nica del Poder Legislativo y el art\u00edculo 53 de la Ley de Participaci\u00f3n Ciudadana, todas del Estado de Baja California Sur, es que se busca dar claridad a la redacci\u00f3n del art\u00edculo 223 de la Ley Org\u00e1nica del Poder Legislativo de la Entidad con relaci\u00f3n al derecho que en este caso refiere para reformar y adicionar la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Baja California Sur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Por lo anterior, Moreno Higuera \u00a0propuso se reforma el art\u00edculo 223, para quedar como siguiente:\u00a0 Art\u00edculo 223.- <em>\u201c<\/em><em>Las iniciativas que tengan por objeto reformar o adicionar la Constituci\u00f3n Pol\u00edtica del Estado, deber\u00e1n estar suscritas por alg\u00fan Diputado, Fracci\u00f3n Parlamentaria, por el Gobernador, el Tribunal Superior de Justicia o los Ayuntamientos, de acuerdo a lo establecido en la Constituci\u00f3n Pol\u00edtica del Estado y la presente Ley\u201d.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La diputada Mar\u00eda Guadalupe Moreno Higuera (Morena) present\u00f3 al pleno una iniciativa que tiene por objeto modificar la Ley Org\u00e1nica<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-121784","post","type-post","status-publish","format-standard","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
