{"id":125717,"date":"2023-06-20T15:42:21","date_gmt":"2023-06-20T21:42:21","guid":{"rendered":"https:\/\/nbcs.mx\/?p=125717"},"modified":"2023-06-20T15:42:21","modified_gmt":"2023-06-20T21:42:21","slug":"propone-diputada-devolver-atribuciones-al-congreso-de-bcs-en-materia-de-impuestos","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=125717","title":{"rendered":"Propone Diputada devolver atribuciones al Congreso de BCS en materia de impuestos"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-125718 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2023\/06\/DIP-PAZ-DEL-ALMA-OCHOA-AMADOR-230620-2-743x492.jpg\" alt=\"\" width=\"346\" height=\"229\" \/>Al violentarse la facultad que constitucionalmente se le otorga al Congreso del Estado de Baja California Sur (art\u00edculo 64 fracci\u00f3n XXXI) relativo a la aprobaci\u00f3n de los impuestos que se impondr\u00e1n a la poblaci\u00f3n, al no estar contenidas en Ley de Ingresos para el Estado, sino en otras como en la Ley de Hacienda o la de Derechos y Productos para el Estado, fue que la Diputada Paz del Alma Ochoa Amador present\u00f3 iniciativa con proyecto de decreto para reformar la Ley de Derechos y Productos del Estado de Baja California Sur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">En ese tenor, Ochoa Amador a\u00f1adi\u00f3 que en las disposiciones de La ley de Hacienda se establece que las tarifas se actualizar\u00e1n autom\u00e1ticamente respecto del \u00edndice de inflaci\u00f3n, lo que evita que el Poder Ejecutivo someta a consideraci\u00f3n del Congreso una parte importante de las contribuciones que por mandato constitucional deber\u00edan ser aprobadas en correlaci\u00f3n con el Presupuesto de Egresos de manera anual como disponen las propias leyes.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">La representante popular subray\u00f3 que las faltas a las normas constitucionales no son exclusivas de la Ley de Hacienda o de la Ley de Derechos y Productos del Estado, si no que dijo, \u201cexisten otras disposiciones tanto estatales como municipales que transgreden las facultades del Poder Legislativo de aprobar las contribuciones que se impondr\u00e1n a la poblaci\u00f3n, lo cual adem\u00e1s de contravenir disposiciones constitucionales, despoja de su esencia a nuestro sistema democr\u00e1tico al anular el principio b\u00e1sico de la soberan\u00eda popular y de igual manera despoja a nuestro sistema republicano del principio b\u00e1sico de la divisi\u00f3n y equilibrio de poderes\u201d, afirm\u00f3 Paz Ochoa.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Por lo anterior, fue que la diputada Paz del Alma Ochoa Amador, propuso modificar dicho p\u00e1rrafo para que se d\u00e9 mayor claridad a la prevenci\u00f3n que se establece, en raz\u00f3n de que la Suprema Corte de Justicia de la Naci\u00f3n resolvi\u00f3 que el cobro de los derechos debe de hacerse en apego al costo que tiene para el Estado brindar el servicio solicitado, pudiendo desde luego agregar una carga financiera por gastos de administraci\u00f3n dif\u00edciles de cuantificar, pero no debe de hacerse el cobro con un fin de lucro, es decir, que la tarifa cobrada exceda desproporcionadamente del costo que implica otorgar dicho servicio al ciudadano.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Al violentarse la facultad que constitucionalmente se le otorga al Congreso del Estado de Baja California Sur (art\u00edculo 64 fracci\u00f3n<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-125717","post","type-post","status-publish","format-standard","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
