{"id":141691,"date":"2024-10-03T17:14:23","date_gmt":"2024-10-03T23:14:23","guid":{"rendered":"https:\/\/nbcs.mx\/?p=141691"},"modified":"2024-10-03T17:14:23","modified_gmt":"2024-10-03T23:14:23","slug":"propone-diputada-lupita-saldana-castigar-fuertemente-el-abuso-contra-menores-elevando-la-edad-en-el-delito-de-estupro","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=141691","title":{"rendered":"Propone diputada Lupita Salda\u00f1a castigar fuertemente el abuso contra menores, elevando la edad en el delito de estupro"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-141692 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-738x492.jpeg\" alt=\"\" width=\"381\" height=\"254\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-738x492.jpeg 738w, https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-1024x682.jpeg 1024w, https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-150x100.jpeg 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-768x512.jpeg 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1-1536x1023.jpeg 1536w, https:\/\/nbcs.mx\/wp-content\/uploads\/2024\/10\/DIP-LUPITA-SALDANA-241003-1.jpeg 1600w\" sizes=\"auto, (max-width: 381px) 100vw, 381px\" \/>La diputada Lupita Salda\u00f1a (PAN) propuso en el Congreso del Estado de Baja California Sur reformas al C\u00f3digo Penal para el Estado, a fin de proteger a los menores de 15 a\u00f1os de edad, para que a pesar de que aun dando su consentimiento a una relaci\u00f3n sexual, se considere como una violaci\u00f3n equiparada, se sancione de acuerdo con la gravedad de la conducta y se tipifique como el delito de estupro.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">La legisladora propuso reformar los art\u00edculos 178 y 184 del C\u00f3digo Penal referentes al delito de estupro, para elevar la edad legal m\u00ednima para el consentimiento sexual; de 12 a\u00f1os, como actualmente est\u00e1 prevista en el c\u00f3digo vigente, a 15 a\u00f1os de edad, \u201cde facto se podr\u00eda considerar que estamos consintiendo o tolerando un tipo de abuso o violencia infantil\u201d, explic\u00f3 la legisladora en tribuna.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Es decir la propuesta establece que el delito de estupro se cometer\u00e1 contra personas mayores de 15 a\u00f1os y menores de 18 a\u00f1os, y en menores de 15 a\u00f1os se considerar\u00e1 como violaci\u00f3n equiparada, aun cuando otorguen su consentimiento, por lo que es necesario elevar la edad legal m\u00ednima para el consentimiento sexual, para proteger a los menores y castigar fuertemente el abuso.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Fijar la edad de 12 a\u00f1os en el caso del estupro es muy baja para que los adolescentes sean legalmente responsables del libre ejercicio de su sexualidad, en tal raz\u00f3n, creemos que es necesario elevar la edad m\u00ednima para el consentimiento sexual, porque ayudar\u00e1 significativamente a proteger a los menores de abusos y violencia.
