respecto, el diputado Venustiano P\u00e9rez S\u00e1nchez propuso tipificar el delito de lesiones provocado por animales, espec\u00edficamente causados por perros, para que, desde la v\u00eda penal, se responsabilice a los propietarios o poseedores y se les obligue a la reparaci\u00f3n del da\u00f1o.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>La propuesta adiciona el delito de lesiones del C\u00f3digo Penal del Estado de Baja California Sur para incorporar el delito de \u201cLesiones causadas por animales\u201d, para lo cual se impondr\u00e1n: El pago de la reparaci\u00f3n del da\u00f1o e indemnizaci\u00f3n de perjuicios, cuando la lesi\u00f3n o lesiones tarden menos de 15 d\u00edas en sanar.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>El pago de la reparaci\u00f3n del da\u00f1o, indemnizaci\u00f3n de perjuicios y de 100 a 200 d\u00edas multa, cuando la lesi\u00f3n o lesiones tarden en sanar m\u00e1s de 15\u00a0 y menos de 60 d\u00edas o amerite hospitalizaci\u00f3n; de 300 d\u00edas multa, cuando la lesi\u00f3n o tarden en sanar m\u00e1s de 60 d\u00edas o amerite hospitalizaci\u00f3n.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>Cuando la lesi\u00f3n o lesiones pongan en peligro la vida de la v\u00edctima, se impondr\u00e1n de 300 a 400 d\u00edas multa y prisi\u00f3n de uno a dos a\u00f1os.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>As\u00ed mismo, mandata que se apliquen las reglas del homicidio, si derivado de las lesiones caudadas por una mordedura de animal, sobreviene la muerte de la persona v\u00edctima de ese ataque.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>&nbsp;<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>El iniciador puntualiz\u00f3 que se trata de un problema de salud p\u00fablica que la legislatura debe atender para salvaguardar la integridad f\u00edsica y la salud de las personas, que recurrentemente son atacadas por caninos y que tienen due\u00f1o espec\u00edfico y conocido, para que sean ellos los responsables por las agresiones que causan los animales que tienen bajo su dominio.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>&nbsp;<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>Subray\u00f3 que debido la ausencia de una legislaci\u00f3n adecuada, \u00e1gil y eficaz, no existe el mecanismo para reclamar el pago de los da\u00f1os causados.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>&nbsp;<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>La propuesta de ley fue presentada por el legislador, por peticiones de ciudadanos atacados por caninos, quienes coincidieron en la negativa de los propietarios de animales, quienes se negaron a pagar los gastos de curaci\u00f3n e incapacidad para trabajar, destacando la imposibilidad legal de llamar a cuentas a los responsables, ya que no existe un tipo penal adecuado que se ajuste a estas hip\u00f3tesis.<\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>&nbsp;<\/p>\n<\/div>\n<div>\n<p style=\"text-align: justify;\">Cabe precisar que de acuerdo a la Secretar\u00eda de Salud, en Baja California Sur, en los a\u00f1os \u00a02021 se reportaron 459 mordeduras de perro; en 2022; 576, en 2023, 603; en 2024, 863, y de enero a abril de 2025, se han reportado 207 mordeduras de perro a
