{"id":152107,"date":"2025-06-28T13:28:04","date_gmt":"2025-06-28T19:28:04","guid":{"rendered":"https:\/\/nbcs.mx\/?p=152107"},"modified":"2025-06-28T13:28:04","modified_gmt":"2025-06-28T19:28:04","slug":"aprueban-homologar-el-codigo-civil-de-bcs-en-materia-de-bienes-durante-la-disolucion-del-matrimonio","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=152107","title":{"rendered":"Aprueban homologar el C\u00f3digo Civil de BCS en materia de bienes durante la disoluci\u00f3n del matrimonio"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-152108 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-739x492.jpg\" alt=\"\" width=\"336\" height=\"224\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-739x492.jpg 739w, https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-1024x681.jpg 1024w, https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-150x100.jpg 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-768x511.jpg 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-1536x1022.jpg 1536w, https:\/\/nbcs.mx\/wp-content\/uploads\/2025\/06\/PLENO-3-2048x1363.jpg 2048w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/>La XVII Legislatura del Congreso del Estado de BCS, aprob\u00f3 el dictamen de la Comisi\u00f3n Permanente de Puntos Constitucionales y de Justicia, mediante el cual, en caso de disoluci\u00f3n del concubinato, el concubino o concubina, que se haya dedicado preponderantemente a las labores del hogar, y en su caso, a la crianza de las y los hijos, y cuidados a personas dependientes dentro del hogar, tambi\u00e9n tengan derecho a una compensaci\u00f3n econ\u00f3mica de hasta el 50% de los bienes adquiridos durante el concubinato.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Lo anterior, relativo a la iniciativa presentada por el Diputado Fernando Hoyos Aguilar, mediante la cual se reforma el contenido del art\u00edculo 305 A, en su fracci\u00f3n VII, del C\u00f3digo Civil de BCS, con el fin de hacer posible el pleno reconocimiento al principio de igualdad entre quienes conforman el matrimonio, clarificando en su hip\u00f3tesis la normativa, al no se\u00f1alar actualmente hasta qu\u00e9 porcentaje podr\u00e1 alcanzar la compensaci\u00f3n, \u201cni se toma en consideraci\u00f3n que a veces el trabajo dom\u00e9stico tambi\u00e9n consiste en el cuidado de personas dependientes familiares cercanos de ambos c\u00f3nyuges\u201d, afirm\u00f3 le promovente.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Por lo que tras la aprobaci\u00f3n, la figura de la compensaci\u00f3n econ\u00f3mica tiene el prop\u00f3sito de resarcir a quien est\u00e1 en una situaci\u00f3n de inequidad al t\u00e9rmino del matrimonio, por haberse dedicado a las labores de hogar y por consecuente al cuidado de hijas e hijos, as\u00ed como de las personas adultas mayores o de quienes requieran asistencia, ya que se trata precisamente de asumir las cargas dom\u00e9sticas y familiares lo fundamental para la procedencia de la compensaci\u00f3n.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>La XVII Legislatura del Congreso del Estado de BCS, aprob\u00f3 el dictamen de la Comisi\u00f3n Permanente de Puntos Constitucionales y<\/p>\n","protected":false},"author":1,"featured_media":152108,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-152107","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
