{"id":162281,"date":"2026-03-11T07:44:27","date_gmt":"2026-03-11T14:44:27","guid":{"rendered":"https:\/\/nbcs.mx\/?p=162281"},"modified":"2026-03-11T07:44:27","modified_gmt":"2026-03-11T14:44:27","slug":"proponen-exhortar-al-titular-de-la-profeco-para-que-companias-telefonicas-cumplan-con-la-ley","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=162281","title":{"rendered":"Proponen exhortar al titular de la PROFECO para que compa\u00f1\u00edas telef\u00f3nicas cumplan con la Ley"},"content":{"rendered":"<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-162282 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m-755x489.png\" alt=\"\" width=\"398\" height=\"258\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m-755x489.png 755w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m-1024x663.png 1024w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m-150x97.png 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m-768x497.png 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/03\/Captura-de-pantalla-2026-03-11-a-las-7.44.07-a.m.png 1390w\" sizes=\"auto, (max-width: 398px) 100vw, 398px\" \/>\u201cNo se busca prejuzgar ning\u00fan tipo de irregularidad, por el contrario, la finalidad es que la protecci\u00f3n de los datos personales sea real, tangible, espec\u00edfica y legal [\u2026]\u201d, afirm\u00f3 en tribuna el diputado Erick Iv\u00e1n Agundez Cervantes, al proponer un Punto de Acuerdo mediante el cual el titular de la Procuradur\u00eda Federal del Consumidor (PROFECO), lleve a cabo acciones para que el contrato de adhesi\u00f3n de compa\u00f1\u00edas de telecomunicaciones en BCS como Telcel, AT&amp;T, Movistar, BAIT, entre otras, cumplan cabalmente con lo establecido en la propia Ley Federal de Protecci\u00f3n al Consumidor.<\/p>\n<p style=\"text-align: justify;\">Agundez Cervantes explic\u00f3 que lo anterior atiende al mecanismo mediante el cual las compa\u00f1\u00edas que prestan servicios de telecomunicaciones, como de telefon\u00eda celular, les exigen a usuarios capturar datos personales y biom\u00e9tricos a cambio de la prestaci\u00f3n del servicio, considerando el acto como un aspecto delicado dentro de los contratos de adhesi\u00f3n, lo que ha provocado incertidumbre dentro de la ciudadan\u00eda, ya que est\u00e1 estrictamente relacionado con el consentimiento otorgado por parte de usuarios para el tratamiento de sus datos personales.<\/p>\n<p style=\"text-align: justify;\">El promovente precis\u00f3 que si bien las compa\u00f1\u00edas de telecomunicaciones forman parte esencial de la vida, no solo por su capacidad de cerrar la brecha digital y fomentar sociedades del conocimiento, sino tambi\u00e9n por la contribuci\u00f3n a la inclusi\u00f3n e interacci\u00f3n social, es necesario que la PROFECO garantice la protecci\u00f3n de los datos personales a fin de evitar un da\u00f1o o riesgo a la seguridad f\u00edsica o moral por medio de diversas pr\u00e1cticas como el robo de identidad, o que terceros hagan mal uso de fotograf\u00edas, correos o mensaje, etc., sin la autorizaci\u00f3n del leg\u00edtimo due\u00f1o.<\/p>\n<p style=\"text-align: justify;\">El legislador precis\u00f3 que el hecho de ceder informaci\u00f3n personal a las compa\u00f1\u00edas que prestan los servicios de telecomunicaciones y de telefon\u00eda celular, implica que comparta con bancos, comercios, negocios, ventas, tarjetas de cr\u00e9dito, pr\u00e9stamos y anuncios, ejercicio que se encuentra prohibido por la Ley Federal de Protecci\u00f3n al Consumidor, la Ley Federal de Telecomunicaciones y la propia Ley General de Protecci\u00f3n de Datos Personales.
