{"id":164762,"date":"2026-05-05T17:10:20","date_gmt":"2026-05-05T23:10:20","guid":{"rendered":"https:\/\/nbcs.mx\/?p=164762"},"modified":"2026-05-05T17:10:20","modified_gmt":"2026-05-05T23:10:20","slug":"proponen-reformas-al-codigo-civil-estatal-en-materia-de-proteccion-y-bienestar-animal","status":"publish","type":"post","link":"https:\/\/nbcs.mx\/?p=164762","title":{"rendered":"Proponen reformas al C\u00f3digo Civil estatal en materia de protecci\u00f3n y bienestar animal"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-164763 alignleft\" src=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-739x492.jpg\" alt=\"\" width=\"374\" height=\"249\" srcset=\"https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-739x492.jpg 739w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-1024x681.jpg 1024w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-150x100.jpg 150w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-768x511.jpg 768w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-1536x1022.jpg 1536w, https:\/\/nbcs.mx\/wp-content\/uploads\/2026\/05\/DIP-ERICK-IVAN-AGUNDEZ-CERVANTES-260505-2-2048x1363.jpg 2048w\" sizes=\"auto, (max-width: 374px) 100vw, 374px\" \/>La Mesa Directiva de la XVII Legislatura del Congreso de BCS turn\u00f3 a las comisiones unidas de Puntos Constitucionales y de Justicia y de Ecolog\u00eda y Medio Ambiente, la iniciativa presentada por el diputado Erick Ivan Agundez Cervantes la cual tiene como prop\u00f3sito establecer el reconocimiento de los animales como seres sintientes, as\u00ed como que su adopci\u00f3n y apropiaci\u00f3n implicar\u00e1 siempre su tutela responsable, de conformidad con lo establecido en la Ley de Protecci\u00f3n de los Animales Dom\u00e9sticos para Baja California Sur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">En la exposici\u00f3n de motivos, el promovente fue puntual al se\u00f1alar que la presente iniciativa se alinea con los postulados establecidos por la Asamblea de las Naciones Unidas para el Medio Ambiente, instancia que ha reconocido expresamente el v\u00ednculo entre el bienestar animal y la protecci\u00f3n del medio ambiente.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Agundez Cervantes enfatiz\u00f3 que el bienestar animal constituye un componente esencial del derecho humano a un medio ambiente sano, en tanto que la forma en que las sociedades tratan a los animales impacta directamente en la salud de los ecosistemas, la biodiversidad y, por ende, en el desarrollo y bienestar de las personas.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Por lo que, en apego a lo estipulado por la Suprema Corte de Justicia de la Naci\u00f3n, la cual ha reconocido que los animales deben ser considerados seres sintientes, merecedores de protecci\u00f3n jur\u00eddica, en aras de una sociedad m\u00e1s justa y sostenible, criterio sostenido por la Primera Sala de ese M\u00e1ximo Tribunal en la sentencia del Amparo en Revisi\u00f3n 163\/2018, es que el legislador busca contemplar en la legislaci\u00f3n el reconocimiento expreso de los animales como seres sintientes.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">En consecuencia, para los alcances anteriormente planteados, se propone reformar la denominaci\u00f3n del Cap\u00edtulo II del T\u00edtulo Cuarto del libro Segundo y la fracci\u00f3n V del art\u00edculo 758, los art\u00edculos 880 y 881; y se adiciona un art\u00edculo 862 Bis, todo al C\u00f3digo Civil para el Estado de Baja California Sur.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Mesa Directiva de la XVII Legislatura del Congreso de BCS turn\u00f3 a las comisiones unidas de Puntos Constitucionales y<\/p>\n","protected":false},"author":1,"featured_media":164763,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[48],"tags":[],"class_list":["post-164762","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-congreso-de-bcs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
