Estado aprob\u00f3 la iniciativa presentada por la Comisi\u00f3n Permanente de Derechos Humanos y Asuntos Ind\u00edgenas y Afromexicanos, integrada por el diputado Mart\u00edn Escogido Flores, presidente y las diputadas Dalia Collins y Cristina Contreras, secretarias, para dar cumplimiento a la resoluci\u00f3n emitida por la Suprema Corte de Justicia de la Naci\u00f3n (SCJN) que mandata la obligatoriedad de dar cumplimiento a diversas consideraciones de reforma a la Ley de Derechos de las Personas, Pueblos y Comunidades Ind\u00edgenas y Afromexicanas de Baja California Sur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Lo anterior, en atenci\u00f3n al resolutivo de la Acci\u00f3n de Inconstitucionalidad 124\/2025, en el que se declara la invalidez de las disposiciones del Art\u00edculo 99, fracciones I,\u00a0 en su porci\u00f3n normativa, <em>\u201cmodo honesto de vivir\u201d<\/em>, y II, la cual se\u00f1ala, <em>\u201cContar con t\u00edtulo expedido por instituciones de educaci\u00f3n superior legalmente facultada para ello, de cuando menos 5 a\u00f1os anteriores a la fecha de su designaci\u00f3n\u201d;<\/em> toda vez que, dichas normativas incluidas en la ley estatal de comunidades ind\u00edgenas y afromexicanas, vulneran los derechos de igualdad, no discriminaci\u00f3n, seguridad jur\u00eddica y acceso a cargos p\u00fablicos, representan barreras desproporcionadas para la participaci\u00f3n efectiva de las personas ind\u00edgenas y afromexicanas, exclusi\u00f3n injustificada a personas con trayectoria, experiencia y legitimidad comunitaria, en un contexto de desigualdad estructural en el acceso a la educaci\u00f3n.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align: justify;\">Cabe se\u00f1alar que el resolutivo emitido por la SCJN, respalda los argumentos de las porciones normativas impugnadas por la Comisi\u00f3n Estatal de Derechos Humanos (CEDHBCS), al vulnerar los principios de legalidad y seguridad, toda vez que el legislador tiene la obligaci\u00f3n de establecer requisitos claros, objetivos y verificables para el acceso a los servicios p\u00fablicos y, sostiene tambi\u00e9n que los requisitos restringen injustificadamente el derecho al trabajo y acceso a cargos p\u00fablicos de personas y comunidades Ind\u00edgenas y Afromexicanas de BCS.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\n<p style=\"font-weight: 400; text-align:
